Clark stands firm on Health Board

Fenwick-Beinema must vacate landfill lawsuit

March 22, 2010
SOUTHBRIDGE — Town Manager Christopher Clark has threatened to remove Board of Health member Ann Fenwick-Beinema from her position over concerns centering on her involvement with the landfill lawsuit.

Since last fall, Attorney Kirstie Pecci, who represents Beinema and other members of a 10-citizen group, has been trying to overturn the Board of Health 2008 site assignment decision to allow expansion of trash deposition at the Southbridge landfill. Among other things, Pecci has urged Judge Dennis Curran to include documents and recordings purporting to support, that the board was "illegally constituted" and violated various procedural requirements during its hearings.

Beinema declined to comment, saying she wants to consult an attorney first, but did indicate she will continue her efforts to remove her name from the suit. Pecci, who represents Beinema and others, said she is working to remove Beinema from the case.
